NP practice authority varies by state: FULL (independent practice), REDUCED (collaborative agreement required), or RESTRICTED (physician supervision required). Whether an NP can own and run the clinic without a physician depends on this tier.
Confirm your state's NP practice tier, and where required, execute and file a written collaboration/supervision agreement with a physician before the NP evaluates patients or prescribes.
California Strict CPOM — Physician-Owned PC Required
California strictly enforces the Corporate Practice of Medicine: only a licensed physician may own a medical professional corporation; lay ownership requires an MSO/MSA structure.
Form a physician-owned Professional Corporation and, if a non-clinician is involved, a separate MSO bound by a fair-market-value Management Services Agreement (no fee-splitting).
